These Terms of Service ("Terms") govern your use of the Elevayte website at elevayte.com (the "Site") and the services offered through it (the "Services"), both operated by Nozaro Inc. ("Nozaro", "we", "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
Elevayte is a curated premium domain marketplace. The Site allows visitors to browse, search, and inquire about domain names offered by Nozaro or its affiliated sellers. Inquiry submissions do not constitute a binding acquisition — binding terms arise only from a written agreement between Nozaro and the buyer for a specific transaction.
You must be at least 18 years old and legally capable of entering binding contracts in your jurisdiction to initiate a transaction through the Site. By submitting an inquiry, you represent that you meet these requirements.
Domain names presented on the Site are described in good faith. Availability, pricing, and descriptions are subject to change without notice until a binding transaction agreement is executed. We do not guarantee that any specific domain remains available at any time prior to contract execution.
When you submit an inquiry, you authorize Nozaro to respond using the contact details you provided. You are responsible for the accuracy of the information you submit. We may decline to respond to inquiries that appear abusive, fraudulent, or automated.
All domain-transfer transactions are executed under a separate written purchase agreement. Transactions above CAD $5,000 (or USD equivalent) are completed through a regulated third-party escrow service. Transfer of ownership completes via ICANN-accredited registrar push, typically within 24–48 hours of escrow clearance. Any applicable escrow, registrar, or tax fees will be disclosed in writing before funds move.
The Site, its content (including text, graphics, logos, and code), and the Elevayte name and mark are the property of Nozaro Inc. or its licensors. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission, except for incidental, non-commercial use.
The presence of a domain name in the Elevayte catalog does not constitute a warranty that the name is free of third-party trademark claims in any particular jurisdiction. Buyers are responsible for their own trademark clearance and due diligence.
You agree not to use the Site: (a) for any unlawful purpose; (b) to scrape, crawl, or harvest data except as permitted by our robots.txt; (c) to interfere with the Site's operation or security; (d) to submit false, misleading, or fraudulent inquiries; or (e) to infringe the rights of Nozaro or any third party.
The Site and its content are provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Your use of the Site is at your own risk.
To the maximum extent permitted by law, in no event will Nozaro Inc., its officers, directors, employees, or affiliates be liable to you for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site or the Services, even if advised of the possibility of such damages.
In all cases, Nozaro's total aggregate liability to you arising from or related to your use of the Site or these Terms will not exceed CAD $100. This limitation applies regardless of the legal theory asserted.
This limitation of liability does not apply to the performance of obligations under an executed domain-purchase agreement, which is governed by its own terms.
You agree to indemnify and hold Nozaro Inc. harmless from any claims, losses, or damages, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising from or related to these Terms or the Site will be brought exclusively in the courts located in Toronto, Ontario, Canada, and you submit to the jurisdiction of those courts.
We may revise these Terms from time to time. The "Last updated" date reflects the most recent version. Continued use of the Site after changes constitutes your acceptance of the revised Terms.
